For the purposes of these Terms, "Dr Padel Racket", "we", "our" refer to Machado Sports, Lda. "Client", "you" refer to any person who accesses the website or places an order.
2. Scope and Acceptance
These Terms apply to:

Dr Padel Racket reserves the right to update these Terms at any time. The version applicable to each order is the one in force at the time of its placement.
3. Products and Services
3.1. Products
Dr Padel Racket sells padel rackets, accessories, and related products, with descriptions, images, and prices available on the website. The images are for illustrative purposes only, and there may be slight variations in color or finish.
3.2. Repair Services
Dr Padel Racket provides specialized padel racket repair services. Each intervention is preceded by a quote communicated to the client. The repair only begins after express acceptance of the quote.
3.3. Customization Services
We offer customization services (painting, laser or color engraving, grips, weight and balance modification, strings). These services consist of goods made to the client's specifications or clearly personalized, and are excluded from the right of free withdrawal in accordance with Article 17, No. 1, paragraph c) of Decree-Law No. 24/2014.
3.4. Deadlines
Estimated deadlines are communicated at the time of the quote and may vary depending on the complexity of the service, material availability, and workload.
4. Prices
All prices are presented in euros (€) and include VAT at the legal rate in force, unless otherwise stated.
Dr Padel Racket reserves the right to change prices at any time. The price applicable to an order is the one in force at the time of its confirmation.
For shipments outside the European Union, prices do not include customs duties, taxes, or local fees, which are the responsibility of the recipient.
5. Orders
Placing an order through the website constitutes a contract proposal. The contract is considered concluded only after express confirmation from Dr Padel Racket, sent by email.
Dr Padel Racket may refuse orders, particularly in cases of:

6. Payments
6.1. Accepted methods
Dr Padel Racket accepts the following payment methods:

6.3. Security
Dr Padel Racket does not have access to or store banking data (card numbers, CVV, etc.). All transactions are carried out in a secure environment with HTTPS/SSL, strong 3D Secure 2 authentication, and PCI-DSS standards applicable to partners.
6.4. Payment timing

Product purchase: full payment at the time of order.

Repair services: payment after service completion, before shipping or racket collection.

Customization services: due to their personalized nature, full or partial advance payment may be required, with conditions communicated in the quote.
6.5. Invoicing
The invoice is issued in the name of the entity indicated by the client at the time of purchase and sent by email. For invoicing with a tax identification number, the client must provide it in the order. Subsequent changes are only possible under legal terms.
7. Delivery and Shipping
7.1. Delivery zones
Dr Padel Racket ships to mainland Portugal and islands, to the European Union, and internationally. Available zones and respective costs are presented at checkout.
7.2. Logistics partners
Dr Padel Racket works with various logistics partners (carriers and collection points). The carrier used for each shipment depends on the destination, service type, and weight.
7.3. Delivery times
Delivery times are indicative and start counting from dispatch:

Mainland Portugal: 1 to 3 business days

Islands (Azores and Madeira): 3 to 7 business days

European Union: 3 to 10 business days

Rest of the world: 7 to 20 business days
Dr Padel Racket is not responsible for delays attributable to carriers, customs authorities, or force majeure events.
7.4. Shipping costs
Costs are calculated based on destination and weight, and are transparently presented at checkout before finalizing the purchase.
7.5. Verification upon receipt
The client must check the order's condition upon receipt. Any anomaly (damaged packaging, missing product, etc.) must be reported in writing within a maximum of 48 hours to info@drpadelracket.com.
7.6. Repairs and customizations - Collection and return
For repair and customization services, the client can:

Send the racket directly to the address indicated by Dr Padel Racket

Use a partner collection point

Request a collection organized by Dr Padel Racket
Shipping/collection costs are communicated to the client before accepting the service.
8. Racket Collection and Abandonment
Upon completion of the repair or customization service, the client is notified by email or WhatsApp to proceed with payment and indicate the racket's return method.
Dr Padel Racket stores the racket free of charge for a maximum period of 8 weeks (2 months) after service completion. After this period, and in the absence of payment or client response, Dr Padel Racket will consider the racket abandoned, in accordance with Article 1323 of the Civil Code, reserving the right to dispose of it without the need for compensation or reimbursement.
This provision is reinforced in all service completion notifications.
9. Returns and Right of Free Withdrawal
9.1. Right of free withdrawal (14 days)
If you are a consumer (an individual who purchases products for non-professional purposes), you have the right to withdraw from the contract, without any reason, within 14 consecutive days from the date of product receipt, in accordance with Decree-Law No. 24/2014.

The deadline is considered met if the communication is sent before the end of the 14 days.
9.2. Exceptions to the right of free withdrawal
In accordance with Article 17, No. 1 of DL 24/2014, the right of free withdrawal does not apply to:

Personalized products: rackets with custom paint, engravings with name or logo, custom weight/balance changes, custom strings, custom grips, and any other product made to client specifications.

Repair services: after execution, as the intervention was previously accepted through a quote and is, by its nature, irreversible.
-
Services fully performed with the consumer's prior and express agreement, acknowledging that they will lose their right of free withdrawal after execution.
-
Sealed products which, for hygiene reasons, cannot be returned after opening.
By ordering a product or service covered by these exceptions, the client expressly acknowledges and accepts this limitation.
9.3. Product return
The product must be returned within a maximum of 14 days after the communication of free withdrawal, to the following address (confirm in advance by email):

Product in perfect condition

Original packaging, including accessories, labels, and documentation

No signs of use beyond what is necessary to ascertain the nature, characteristics, and functioning of the product
The client is responsible for any depreciation resulting from excessive handling.
9.4. Refunds and costs
Dr Padel Racket refunds all payments received, including delivery costs (except additional costs resulting from choosing a more expensive delivery method than the least expensive one offered), within a maximum of 14 days from the communication of withdrawal. The refund is made using the same payment method as the initial transaction, unless otherwise agreed. Dr Padel Racket may withhold the refund until it receives the product back or until the client provides proof of shipment.
Direct return costs are borne by the client, unless the product is returned due to defect, non-conformity, or an error attributable to Dr Padel Racket.

10. Warranties
New products benefit from the legal warranty of conformity of 3 years provided for in Decree-Law No. 84/2021, applicable to consumers.
Repair and customization services benefit from a 4-month warranty on the intervention, not covering:

Damage resulting from improper use, natural wear and tear, or subsequent impacts

Alterations or interventions made by third parties after delivery

Damage to parts of the racket not covered by the original intervention
In case of defect or non-conformity, contact us by WhatsApp within a maximum of 30 days after detection, indicating the order number, problem description, and photographs.
11. Liability
Dr Padel Racket is not responsible for:

Improper use of products by the client

Consequential or indirect damages

Temporary unavailability of the website due to technical reasons or force majeure

Delays attributable to carriers or customs authorities
12. Intellectual Property
All website content (texts, images, logos, design, code) is the property of Dr Padel Racket or its licensors, protected by copyright and industrial property law. Reproduction, distribution, or modification is prohibited without prior written authorization.
13. Data Protection
The processing of personal data is governed by the Privacy Policy, available at www.drpadelracket.com/pages/politica-de-privacidade, which is an integral part of these Terms.

15. Applicable Law and Jurisdiction
These Terms are governed by Portuguese law. For the resolution of any dispute, the courts of the district of Vila do Conde have jurisdiction, with express waiver of any other forum, unless there is an imperative legal provision to the contrary.
